A quote is only binding after the application is complete, indemnitors are qualified, any collateral (if required) is accepted, and the surety writing the bond has approved it.
California bail bond premiums are filed with and regulated by the California Department of Insurance. Agents must charge the rate filed by the surety. The premium is a percentage of the full bail amount set by the court, most commonly 10%. That premium is fully earned when the bond is posted and accepted. It is generally not returned if the case is dismissed, charges are dropped, or the defendant is later found not guilty. The main exception is surrender of the defendant under California Code of Regulations Title 10 § 2090, in which case the premium may be returned minus permitted administrative costs.
Discounted or reduced rates (including military and veteran, union, AARP/senior, lifetime-resident, homeowner, first-responder, law-enforcement, and other categories advertised by this office) are available only when they appear on the applicable filed rate schedule and only when the applicant provides acceptable proof of eligibility within the required time. A category not on the filed schedule cannot be used to reduce the premium.
Financing, 0% interest plans (when offered), 1% down, half-down, no-money-down, and no-collateral arrangements are qualification-based. The exact down payment, installment amounts, due dates, and any collateral are set in a written agreement signed before the bond is posted. Not all applicants will qualify. Other than the filed premium and any actual, necessary, and reasonable expenses permitted by California law, this office adds no hidden fees.
